1. Your Agreement to These Terms of Service
PLEASE READ THESE TERMS OF SERVICE CAREFULLY. They govern your access to and use of our website, aidiagme.com (the “Site”), and all related lab result explanation services (the “Services”).
Smart Medical Care Ltd (“We”, “Us”, “Our”) provides these Services under the AI DiagMe brand. By using our Services, you agree to be bound by these Terms of Service. In addition, you agree to our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree to these conditions, you must not use our Services.
2. Understanding the AI DiagMe Service
2.1. Who We Are
AI DiagMe is a brand of Smart Medical Care Ltd. We are a company registered in England and Wales (Number: 15309552), with our office at 167-169 Great Portland Street, 5th Floor, London, W1W 5PF, United Kingdom. Our mission is to make health information more accessible. We use artificial intelligence (AI) to simplify lab reports (currently blood, urine, and stool) to help you understand your results and facilitate dialogue with your doctor.
2.2. IMPORTANT MEDICAL DISCLAIMER
This is a critical part of our Terms of Service.
The AI DiagMe Service is an informational tool, NOT a medical device. We provide our services for educational purposes only.
The AI-generated information never replaces a diagnosis, consultation, or medical advice from a qualified healthcare professional.
You must always consult with your doctor or another qualified provider about any health decisions. Never delay seeking medical advice because of information you received from our Services.
3. Access and Account Rules in these Terms of Service
3.1. Age Requirement
To use our Services, you must be at least 18 years old. By using the Services, you confirm that you meet this age requirement.
3.2. Providing Accurate Information
To generate a report, you must provide certain information, including your name, email address, and your lab report. You agree that all information you provide will be accurate and complete, as detailed in our Privacy Policy.
3.3. Future Patient Portal
Currently, you can purchase reports without creating a formal account. However, we plan to use your purchase information to automatically create a secure account on our “Patient Portal.” This future portal will allow you to access past reports and manage your data. We will inform you about login procedures when this feature is available. You will be responsible for keeping your future login details confidential.
4. Permitted Use of Our Services
4.1. Your License to Use the Service
We grant you a limited, non-exclusive, and revocable license to use the Services for personal, non-commercial purposes. This means you can view your report, print it, and discuss it with your healthcare professionals. Any other use, such as reselling or distributing the content, is prohibited without our prior written consent.
4.2. Prohibited Activities
You agree not to use the Services to:
- Violate any laws or third-party rights.
- Impersonate another person.
- Attempt to reverse-engineer our technology.
- Automatically “scrape” or extract data from our Site.
- Interfere with our security measures or develop a competing product.
5. Content and Data Within Our Terms of Service
5.1. Your Input Data
You are responsible for the information and files you submit (“Input Data”). You retain full ownership of your Input Data. Furthermore, you guarantee that you have the necessary rights to provide this data to us.
5.2. AI-Generated Output Data
The report our AI generates is the “Output Data.” Under these Terms of Service, we assign to you all our rights and interest in the specific Output Data created for you.
5.3. Understanding AI-Generated Content
Artificial intelligence is a probabilistic field. While we strive for accuracy, the Output Data may sometimes contain errors and may not be unique to you. Therefore, you acknowledge that the Output Data is for informational guidance only and should never be considered infallible or a substitute for professional medical advice.
6. Fees, Payment, and Refunds
6.1. Pricing and Payment Terms
Generating a report requires payment. We display the applicable prices in US Dollars ($) on the Site at the time of your order. You must provide valid payment information to our secure payment provider, Stripe. We do not store your full credit card details.
6.2. Future Subscription Terms
Currently, we only offer single-payment reports. We may offer subscription plans in the future. If we introduce subscriptions, we will clearly communicate all specific terms (price, renewal, cancellation) beforehand.
6.3. Right of Withdrawal and Refunds
Right of Withdrawal (UK & EU Consumers): In accordance with consumer protection laws in the UK and the EU, you generally have a 14-day right to withdraw from a digital service contract. Because we provide the digital content (the AI report) immediately upon your request and currently do not require you to expressly waive this right at checkout, you retain your legal right to withdraw within 14 days of your order. To exercise this right, simply contact us at contact@aidiagme.com, and we will issue a full refund.
General Refund Policy: Independent of the right of withdrawal, if you reside outside the UK/EU or if you believe the Service provided has a major malfunction or is not as described (keeping in mind the informational and probabilistic nature of AI as described in Section 5.3), please contact us at contact@aidiagme.com. We will review your request and may offer a new report generation or a refund.
7. Termination of this Service Agreement
You may stop using the Services at any time. We may also suspend or terminate your access if you violate these Terms of Service, pose a security risk, or if we are required to by law.
8. Disclaimers and Limitation of Liability
8.1. “AS IS” Service
WE PROVIDE THE SERVICES “AS IS” AND “AS AVAILABLE.” ALSO, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. FINALLY, WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
8.2. Limitation of Our Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
9. Legal Framework of These Terms
9.1. Dispute Resolution
We encourage you to contact us first to resolve any dispute amicably. These Terms of Service are governed by the laws of England and Wales. However, if you are a consumer residing in the UK or the European Union, you also benefit from any mandatory provisions of the law of the country in which you are resident, and you may bring legal proceedings in either the courts of England and Wales or the courts of your country of residence.
9.2. Changes to These Terms of Service
We reserve the right to modify these Terms at any time. If we make substantial changes, we will notify you before they take effect. Your continued use of the Services after the changes constitutes your acceptance of the new Terms.
10. General Provisions
These Terms of Service, along with our Privacy and Cookie Policies, constitute the entire agreement between you and us. You may not assign your rights under these Terms without our consent. If any part of these Terms is found to be unenforceable, the remaining provisions will still be in effect.
